Terms & Conditions

1. Scope

These Terms & Conditions (“Terms”) apply to all training services and consulting engagements provided by Top Skill Pro (“Company”) to its clients, including individuals, teams, and organizations. They govern the rights and obligations of both parties from the initial inquiry through completion of all contracted services. Any conflicting terms from the client shall only become part of the contract if explicitly agreed in writing by the Company.

2. Contract Formation

All offers by the Company are non-binding. A binding contract is formed only upon our written confirmation of your order or upon signing of our training agreement. The scope of services, fees, and schedule will be detailed in that confirmation. Verbal side agreements or amendments require written confirmation by the Company to be effective.

3. Services

The Company provides the services specified in the training confirmation, including but not limited to:

  • Live or on-demand course access (basic, business, or premium modules).
  • One-on-one coaching sessions and group workshops.
  • Custom curriculum design and resource materials.
  • Follow-up support and progress check-ins.

Additional services (e.g., tailored corporate programs, extended coaching packages) may be provided upon separate agreement. Any change in scope must be confirmed in writing.

4. Fees & Payment

Fees are based on the plan selected (Basic, Business, Premium) or an agreed hourly rate. All fees are exclusive of Swiss VAT. Expenses such as travel or materials may be invoiced separately.

  • Invoices for one-time services are issued upon completion; recurring fees are billed monthly.
  • Payment is due within 14 days of invoice date, net, without deduction.
  • Late payment may incur interest at the statutory rate and suspension of services until full payment is received.

5. Refund Policy

Your satisfaction is our priority. If you’re not fully satisfied, the following refund terms apply:

  • Basic Plan: You may request a full refund within 7 days of purchase and before attending more than one course session.
  • Business & Premium Plans: Within 14 days of purchase, you may request a 50% refund if less than 20% of the contracted hours have been used. Hours already delivered are invoiced at the agreed hourly rate.
  • Refund requests must be sent in writing to [email protected] with your invoice and a brief explanation. We will respond within 14 days.
  • Approved refunds will be credited back to the original payment method within 30 days.

6. Liability

The Company is liable for intent and gross negligence without limitation. For simple negligence, liability is limited to foreseeable damages up to the amount of fees paid for the affected service. Further claims are excluded to the fullest extent permitted by law.

7. Data Protection

We process your personal data in accordance with our Privacy Policy. This includes course registration data, communications, and usage analytics necessary to deliver and improve our services.

8. Governing Law & Jurisdiction

Swiss substantive law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Biel, Switzerland.
